Terms of Service

1. The service

Dump Triage accepts Windows user-mode and kernel-mode crash dumps you upload, runs automated and, where warranted, human-reviewed analysis against them, and returns a root-cause report via API and/or webhook. We may change, suspend, or discontinue features at any time, with reasonable notice for anything materially affecting active customers.

2. Accounts & API keys

You're responsible for keeping your API key confidential and for all activity under your account. Tell us promptly if you suspect a key has been compromised so we can rotate it.

3. Your data

You retain all ownership rights in the crash dumps, transcripts, and reports associated with your account ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the service to you. We act as your data processor for any personal data contained in Customer Data — see our Privacy Policy for how that data is handled, retained, and shared with subprocessors.

You represent that you have the right to upload the dumps you send us, including any necessary rights or consents covering personal data they may contain about your own end users or employees. In practice: only submit dumps you own or are otherwise authorized to submit — for example, a dump captured on a machine or account that isn't yours, or one you know contains a coworker's or third party's personal data you haven't cleared for this use, is not authorized just because you have a copy of it.

4. Acceptable use

• Don't use the service to upload malware for distribution, or content you don't have the right to share.
• Don't upload a dump you don't own or aren't otherwise authorized to submit — including dumps captured on someone else's machine or account without their consent, or dumps you own but that contain a coworker's or third party's personal data you haven't cleared for this use.
• Don't attempt to access another customer's data, bypass rate limits or authentication, or probe/scan our infrastructure.
• Don't use the service in a way that violates applicable law, including data protection law governing any personal data you upload.

5. Fees & pilot terms

Pilot access is currently offered free or under bespoke terms agreed directly with your point of contact. Paid plans, when introduced, will be described in an order form referencing these Terms.

6. Confidentiality

Each party will protect the other's confidential information (including Customer Data and any non-public information about our systems) with at least the same care it uses for its own confidential information, and not disclose it except as needed to provide or receive the service, or as required by law.

7. Disclaimers

Dump Triage reports are diagnostic aids, not a guarantee of root cause. Tier 1/2 output is AI-generated and may be incomplete or wrong; Tier 3 escalation exists precisely because automated analysis isn't authoritative on its own. The service is provided "as is" during pilot, without warranties of any kind, to the extent permitted by law.

8. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our total liability arising out of the service is limited to the fees you paid us in the 12 months preceding the claim (or, during a free pilot, a nominal amount as set out in your pilot agreement).

9. Termination

Either party may terminate a pilot or subscription with notice as specified in your order form, or, absent one, 30 days' written notice. We may suspend access immediately for a material breach of these Terms, including a violation of §4. On termination, we'll delete or return your Customer Data per the retention terms in our Privacy Policy, unless a longer retention is required by law.

10. Governing law

These Terms are governed by the laws of the jurisdiction specified in your order form or pilot agreement; absent one, by the laws of the United States and the state in which PerformanceInsights.ai is incorporated, without regard to conflict-of-law rules.

11. Changes

We'll update the "last updated" date above when these Terms change, and notify active customers of material changes.
